The following terms and conditions (the “Terms”) govern access and/or use of the website https://www.comenstay.be (hereinafter referred to as the “Site”). These Terms and Conditions apply to all offers, arrangements, reservations, and agreements with regard to the properties rented by Comenstay.
By using the Site, the User accepts and agrees to abide by all of these Terms and Conditions.
The client’s reservation information will be used for the execution of the agreement. Comenstay may also use this data for marketing purposes.
Any agreements deviating from these Terms and Conditions must be agreed upon in writing.
These Terms and Conditions are subject to change at any time. In doing so, the customer’s rights and claims are appropriately considered.

Intellectual property rights of the Site
- Content and Presentation of the Site
The content, organization, and structure of the Site are all original works by Comenstay and are therefore protected by intellectual property rights, such as copyright, database rights, and trademark rights. The articles, texts, layout, logos, images, videos, scripts, and interactive elements that appear on the Site (the “Creations”) are also covered by intellectual property rights and/or other rights and continue to be the sole property of Comenstay.
Any non-private and/or commercial use and reproduction, as well as any communication to the public, adaptation, edit, recording, translation, exploitation, storage, or offer for sale, integration into another website or other medium, and reverse engineering are all prohibited and Comenstay reserves the right to take action against any violation of the above. - Trademarks and names
The brands and names mentioned on the Site may be protected by trademark law and all rights are expressly reserved.
Site access
The User is hereby informed that Comenstay makes no warranties about the reliability of the Site.
Comenstay is not required to maintain the Site accessible at all times. Additionally, Comenstay is free to delete, edit, or otherwise change the Site and its Creations at any time, for any reason, without providing the User with any prior notice.

The websites to which hyperlinks are provided on the Site are not under the control of Comenstay, and as a result, Comenstay is not liable for the content of those websites, including any inappropriate, illicit, or illegal material, or for any links provided on those websites to other websites.

Limitations of liability
Comenstay is accountable for the site’s content and Creations as the site’s publisher.
However, Comenstay cannot be held liable for any direct or indirect damage to the User’s equipment when visiting the Site.
Non-waiver
If Comenstay does not implement one or more articles of the Terms and/or does not assert its rights, will not be interpreted as a renunciation by Comenstay to assert its rights.
Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part of the Terms will be severed and the remaining parts of the Terms will remain valid and enforceable. The Parties agree to substitute a similar clause for the one that is deemed invalid or illegal.
Force majeure
In the event of force majeure, Comenstay shall not be required to fulfill its obligations. Comenstay may suspend its obligations for the duration of the event of force majeure.
Force majeure is any circumstance that is out of Comenstay’s reasonable control, including but not limited to natural disasters, civil unrest, economic unrest, fire, floods, extreme weather, explosions, epidemics or pandemics, terrorism, labour disputes, strikes, any type of industrial action or conflict, as well as any situation that would prevent the regular operation of the rental agreement, and other similar situations that may affect Comenstay, or any of its sub-contractors.
Applicable law
These Terms are subject to and governed by the Belgian law.
Disputes
If there is a disagreement over how these Terms should be interpreted or carried out, the Parties agree to try to reach a mutually agreeable solution before turning to mediation.
Any residual disagreement or contestation shall be under the exclusive jurisdiction of the courts of the judicial district of Brussels if the Parties are unable to negotiate a resolution.
